What is E-Discovery and Electronically Stored Information (ESI)?

Federal Rules of Civil Procedure require that electronically stored information relevant to current and/or possible future litigation be preserved.  For example, e-mails, word processor documents, etc. 

This process typically starts for individuals when they receive a directive in the form of a “Litigation Hold” memo from the Office of the General Counsel.

 

I received a preservation notice from the Office of the General Counsel, what do I do?

I am an IT administrator, how does this all affect me?

Someone that you directly or indirectly support may receive a preservation notice from the Office of the General Counsel (OGC).  This notice describes the process that needs to be followed to preserve ESI.

It’s the responsibility of the individual who received the notice to preserve relevant data.  The individual may ask their IT support to assist with technical aspects of preserving data (E.G. how to mount a network drive, how to copy files, etc.).  A “technical help” site for this process has been deployed at http://cio.uiowa.edu/ITsecurity/litigation/.

 

I haven’t received a notice, but I believe I have something that should be preserved, what do I do?

Contact the Office of General counsel to speak with them about how to proceed.
